Model 231
U.Jet S.r.l. has adopted an Organisation, Management and Control Model (Model 231) to prevent offences that may be committed in the company's interest or to its advantage.
Italian Legislative Decree No. 231 of 8 June 2001 introduced into our legal system the rules on the «liability of entities for administrative offences arising from a crime», under which companies may be held «liable» — and therefore penalised — for certain offences committed, in their interest or to their advantage, by persons in senior positions (so-called «senior figures») and by those subject to their direction and supervision.
The company's liability is however excluded if, before the offences were committed, it had adopted and effectively implemented organisation, management and control models suitable for preventing such offences, and if it had set up a body responsible for overseeing the operation of and compliance with the models.
U.Jet S.r.l. has adopted Model 231 and appointed a Supervisory Body (Organismo di Vigilanza, OdV), with autonomous powers of initiative and control, entrusted with monitoring the operation of and compliance with the model and keeping it up to date.
